Nug&Carol Design Studio Workshop Participant Agreement & Liability Waiver
Effective Date: July 31, 2026
By purchasing a ticket, registering for, or participating in any workshop, class, event, or activity hosted by Nug&Carol Design ("Company," "we," "our," or "us"), you acknowledge that you have read, understood, and agree to the following terms.
1. Voluntary Participation
Participation in our workshops and creative activities is voluntary. You understand that activities may include, but are not limited to:

Painting
-
Drawing
-
DIY crafts
-
Tote bag decorating
-
Wood projects
-
Jewelry making
-
Slime and sensory activities
-
Seasonal crafts
-
Christian-themed workshops
-
Specialty creative events
2. Assumption of Risk
You understand that participating in creative activities involves inherent risks, including but not limited to:

Paint or glue spills
-
Minor cuts or scrapes
-
Hot glue burns
-
Allergic reactions to art supplies
-
Slips or falls
-
Damage to clothing or personal belongings
You voluntarily assume all ordinary risks associated with participation.
3. Release of Liability
To the fullest extent permitted by Tennessee law, you release and hold harmless Nug&Carol Design, its owners, employees, volunteers, contractors, and event hosts from claims arising out of ordinary negligence related to your participation.
This release does not apply to gross negligence, reckless conduct, or intentional misconduct where prohibited by law.
4. Medical Emergencies
If emergency medical treatment becomes necessary, you authorize emergency personnel to provide treatment.
You understand that all medical expenses are your responsibility.
5. Allergies & Sensitivities
Our workshops may use products including:

Acrylic paint
-
Adhesives
-
Wood products
-
Glitter
-
Resin (select workshops)
-
Latex-containing products
-
Fragrances
-
Cleaning products
Light refreshments may also be served and may contain common allergens.
You are responsible for notifying us before the event of any allergies or medical conditions that may affect participation.
6. Clothing & Personal Property
Creative activities can be messy.
Although aprons may be provided, we recommend wearing clothing that can safely get paint or other art materials on it.
Nug&Carol Design is not responsible for damage to clothing, shoes, bags, jewelry, electronics, or other personal property.
7. Photography & Marketing
Photographs and video may be taken during workshops for promotional purposes.
By participating, you grant Nug&Carol Design permission to use your likeness in marketing materials, social media, and advertising without compensation.
If you prefer not to be photographed, please notify a team member before the event.
8. Minors
Participants under 18 must have a parent or legal guardian complete registration and agree to these terms.
Parents and guardians remain responsible for supervising children unless the event specifically states that supervision is provided.
9. Respectful Environment
To maintain a welcoming, family-friendly, Christ-centered environment, participants agree to:

Treat others with kindness and respect.

Follow instructor directions.
-
Use tools and supplies safely.
-
Refrain from disruptive, abusive, or unsafe behavior.
Nug&Carol Design reserves the right to remove any participant whose behavior creates a safety concern or substantially disrupts the event. Refunds are not guaranteed in these situations.
10. Refunds & Cancellations
Workshop purchases are subject to our published cancellation and refund policy.
Failure to attend a scheduled workshop does not automatically entitle a participant to a refund.
11. Intellectual Property
Workshop designs, templates, instructional materials, and original artwork remain the intellectual property of Nug&Carol Design unless otherwise stated.
Materials may not be reproduced or commercially distributed without written permission.
12. Governing Law
This agreement shall be governed by the laws of the State of Tennessee.
Any dispute arising from participation shall be resolved in accordance with applicable Tennessee law.
13. Acknowledgment
By purchasing a ticket or participating in a Nug&Carol Design workshop or event, you acknowledge that:

You have read and understand this agreement.

You voluntarily accept the ordinary risks of participation.

You agree to follow all safety instructions provided by staff.

You agree to these terms on behalf of yourself and any minor for whom you are registering.
14. Ticket Purchase Terms & Conditions
By purchasing a ticket for a Nug&Carol Design workshop or event, you agree to the following:
Ticket Purchase
Tickets are sold on a first-come, first-served basis and are not guaranteed until payment has been successfully processed.
All prices are listed in U.S. Dollars and applicable sales tax and processing fees may be added at checkout.
Limited Seating
Workshops have limited seating to ensure an enjoyable experience for all participants.
Once a workshop reaches capacity, additional registrations cannot be accepted unless additional seats are released.
Non-Refundable Tickets
Unless otherwise stated for a specific event, workshop tickets are non-refundable.
Because materials are purchased and prepared in advance based on registrations, we cannot offer refunds for missed workshops, schedule conflicts, or changes in personal plans.
Rescheduling
If you are unable to attend, you may request to transfer your reservation to another eligible workshop or receive a studio credit.
Requests must be received at least 72 hours before the scheduled workshop.
Transfers and credits are subject to availability and are not guaranteed.
No transfers, credits, or refunds will be issued for requests made less than 72 hours before the event or for no-shows.
Ticket Transfers
Tickets may be transferred to another individual with prior approval from Nug&Carol Design.
The original purchaser remains responsible for ensuring the new participant receives all event information and agrees to these terms.
Late Arrivals
Please arrive 10–15 minutes before your scheduled workshop.
To avoid disrupting instruction, participants arriving more than 20 minutes after the scheduled start time may not be permitted to join the workshop.
Late arrivals are not eligible for refunds.
Workshop Changes
Nug&Carol Design reserves the right to substitute instructors, modify projects, adjust supply colors or materials, or make minor schedule changes when necessary without prior notice.
These changes do not constitute grounds for a refund.
Event Cancellation by Nug&Carol Design
If Nug&Carol Design cancels a workshop due to severe weather, instructor illness, low enrollment, facility issues, or other unforeseen circumstances, participants will receive one of the following, at our discretion:

A full refund to the original payment method;

A transfer to another workshop of equal value; or
-
Studio credit for the full purchase amount.
Seating Requests
We will make every reasonable effort to seat members of the same reservation together.
If tickets are purchased separately, seating together cannot be guaranteed unless requested before the event.
Promotional Codes & Gift Cards
Promotional codes must be applied before checkout and cannot be added retroactively.
Gift cards and promotional credits have no cash value except where required by law.
Photography
Workshops may be photographed or recorded for promotional purposes.
By attending, you consent to the use of photographs and video in which you may appear unless you notify staff before the event begins.
Force Majeure
Nug&Carol Design shall not be liable for delays, cancellations, or interruptions caused by circumstances beyond our reasonable control, including but not limited to severe weather, natural disasters, public emergencies, power outages, government actions, labor disputes, or other events that make the workshop impracticable or unsafe.
Chargebacks
If a chargeback or payment dispute is initiated after services have been provided or in violation of these Terms, Nug&Carol Design reserves the right to provide documentation supporting the purchase and these accepted terms to the payment processor or financial institution.
Agreement
By completing your purchase, you acknowledge that:

You understand the cancellation, transfer, and refund policies.

You agree to abide by all studio policies and staff instructions during the event.
